Hyundai Ordered to Pay $14 Million to Man in Brain Injury Lawsuit

A jury has found in favor of a man who suffered severe traumatic brain injuries in an accident when the airbags failed to deploy. A jury has ruled that Hyundai Motor Corporation should pay the man $14 million for his brain injury lawsuit.

A jury has found in favor of a man who suffered severe traumatic brain injuries in an accident when the airbags failed to deploy.  A jury has ruled that Hyundai Motor Corporation should pay the man $14 million for his brain injury lawsuit.

The accident occurred in 2008, when the victim and his parents were driving a Tiburon. The car veered off the roadway and crashed into a tree.  The airbags in the car failed to deploy, and as a result, the victim suffered a serious traumatic brain injury.  The car was equipped with side airbags, but they did not deploy.

According to the lawsuit, the airbags failed to deploy because the auto manufacturer had positioned its side airbag sensors in the wrong location.  In this particular case, the sensors are located under the driver’s seat.  The lawsuit alleges that the company was aware that this particular positioning of the sensors was dangerous, and could possibly lead to injuries in an accident due to airbag failure.

Hyundai disagrees with those charges, and denies that its airbag system was wrongly positioned.  According to the company, its airbag system is in compliance with federal safety standards, and was thoroughly tested and found to comply with all safety regulations.  According to the company, the injuries were the fault of the victim because he drove his car into a tree, and the side airbag system would simply not have been inadequate to prevent his injuries.  The company has announced that it will appeal this verdict.
